SPECIAL NOTE: Sometimes there are regulations that are issued by other divisions of the Department of Industrial Relations that relate to occupational safety and health. For example, a recent proposed regulation from the Division of Labor Standards Enforcement is trying to change meal and rest periods which will impact workers by increasing the likelihood of injury. These were forwarded to Cal/OSHA pursuant to Labor Code 147.2 (3). Click here for the OEHHA report released around December 14, 2007. This report was prepared as a result of a contract between HESIS and OEHHA (click here for a copy of the contract) to provide HESIS information to fulfill their obligations under Labor Code 147.2. This report will provide the basis for HESIS to recommend that occupational safety and health standards be developed for these toxic substances. The report is entitled Occupational Health Hazard Risk Assessment Project for California: Identification of Chemicals of Concern, Possible Risk Assessment Methods, and Examples of Health Protective Occupational Air Concentrations. The report was prepared by the Reproductive and Cancer Health Hazard Assessment Branch Office of Environmental Health Hazard Assessment of the California Environmental Protection Agency (December, 2007). Current 5155 Committee chronology of meetings
June 19, 2007 was the first meeting for the new 5155 regulatory advisory committee meeting to discuss Cal/OSHA's draft list of priorities for updating PELs (permissible exposure limits). The meeting: 1) reviewed procedures and substance priorities, 2) took comments on whether any substances should be removed or added to the list, or have its priority on the list revised, and 3) took comments on whether any substances should be sent to a separate substance-specific advisory committee process. As well, at this meeting Cal/OSHA announced the first meeting date for the 5155 committee and introduce the members of the health expert advisory committee (HEAC).
August 21, 2007, was the second meeting of the HEAC committee. "Favorite" chemicals were suggested for review: sulfuric acid, hydrogen flouride, hydrogen chloride, n-methyl-2-pyrrolidone, carbon disulfide, trichloroethylene, dichloracetic acid.
November 2, 2007, was the third meeting of the HEAC committee. Cal/OSHA's tentative agenda is to review the Priority list of substances to add any revisions made in response to comments and to determine which substances will be discussed a the next HEAC meeting. As well, the HEAC reviewed the following 4 specific substances to recommend a new or revised PEL:

January 29, 2008, was the fourth meeting of the HEAC committee. There was a lengthy discussion about setting priorities and Cal/OSHA has now scheduled an additional meeting on April 4 specifically to address setting priorities. Worksafe argued that the P&P requires priorities to be set, and that chemicals which cause cancer, reproductive and developmental harm should be at the top of the list. Worksafe also argued that Cal/OSHA's volunteer committee doesn't have the same ability as full-time professional staff at sister governmental agencies that have done quantitative risk assessment on numerous workplace chemicals that cause cancer, etc., and that Cal/OSHA should rely more on the QRAs produced by OEHHA and other reputable sources including NIOSH and Federal OSHA. Cal/OSHA determined that there was consensus on the following issues. 1) Substances for consideration by the HEAC should have use in California and the extent and likelihood of worker exposure in California should be a factor in prioritization. 2) HEAC meetings should continue on the individual substances already underway while a process of selection and prioritization of additional substances moves ahead separately. Additionally, Cal/OSHA noted: 1) The Cal/OSHA PEL Policy & Procedures document refers to prioritizing substances for inclusion in the process and this concept should not be abandoned. 2) Good data on usage and potential for worker exposure is difficult to obtain. Industry partners may be one useful source. 3) Three HEAC members said that a consideration in prioritization of substances should be the degree to which substantial risk assessments have already been completed eg. by OEHHA or EPA. 4) One HEAC member echoing the prior comment said that it may be unrealistic to expect HEAC to conduct risk assessments from scratch, and asked how substances without an assessment by OEHHA or other agency should be addressed in the HEAC process.

Previously, the 5155 advisory committee focused on a number of substances. Previous meetings were held on May 18, 2005 and March 30, 2004 for the 9 substances listed below. On October 14, 2004, the committee met to discuss glutaraldehyde. These 10 substances went to the Standards Board for rulemaking as part of Title 8 Section 5155 and were heard at a public hearing on September 15, 2005. The March 30, 2004 advisory committee focused on amendments to 8 CCR 5155, with regard to acetone, beryllium and beryllium compounds,2-butoxyethanol, epichlorohydrin, methyl methacrylate, molybdenum-soluble compounds, propylene oxide, 1,3,5-triglycidyls-triazinetrione, vinylidene fluoride. Previously, the 5155 Committee previously issued a Carcinogen Position Statement. The document also discusses the process the OSH Standards Board traditionally used to update PELs (it started with a base list of substances for which ACGIH had new TLVs and accepted or changed or used other ).

Contact: PURPOSE: This advisory committee is focusing on 8 CCR 4968 with regard to crane warning devices and will consider a new Section 5022.1 regarding crane test weight requirements. The Advisory Committee met on March 3, 2004, and proposed amendments to 8 CCR 4968 (Safety Devices) to prevent overloading of tower cranes and amendments for a new 8 CCR 5022.1 (Test Weights) to require inspection of crane test weights prior to each use and suitable lifting attachments to be used for crane test weights. On June 16, 2005, the Standards Board adopted this proposal. It is currently awaiting approval from the Office of Administrative Law. Click here for the proposal.

NEXT MEETING: none scheduled ACTION: This advisory committee is to discuss the parameters of a regulation to address the risk of respiratory disease posed by workplace exposure to diacetyl and other flavoring substances. It began with a petition to the OSH Standards Board. HISTORY: Cal/OSHA convened regulatory advisory committee meetings on September 28, 2006, February 13, 2007, March 21, 2007 (click here for 3/21/07 Cal/OSHA minutes), May 18, 2007 (click here for 5/18/2007 Cal/OSHA minutes) and July 10, 2007 (click here for 7/10/07 Cal/OSHA minutes).
Worksafe attended. Unions participating (directly or through representatives) included CA Labor Fed, IBT, UFCW, UNITE-HERE. Legal services involved include Coalition of Low Wage Immigrant Advocates (CLIWA) and Centro Legal de la Raza. Assisting as experts were Dr David Egilman, John Froines PhD, and Dr Robert Harrison. Worksafe will continue to work on this issue and we welcome your participation.

PURPOSE: This advisory committee is focusing on changing the regulations that set forth the responsibilities of various types of employers on multi-employer worksites, in particular the controlling employer. The OSH Appeals Board is ignoring the law, including cases decided by the District Court of Appeal on this issue.

The next meeting which was scheduled for July 27, 2005 was cancelled. PURPOSE: This advisory committee is focusing on amendments to 8 CCR 5095-5100 with regard to hearing conservation in construction AND agriculture AND oil and gas well drilling and servicing operations. Right now these industries are EXEMPT from hearing conservation programs. As well this advisory committee will review the status of the other petitions that have been submitted to amend requirements for Appendix C Audiometric Test Rooms and technician qualifications.
At the April 22, 2005, meeting the construction industry withdrew their offer to have construction workers protected with a hearing conservation program (in other words to eliminate the exemption). Farm employers also objected to protecting farmworkers with a hearing conservation program. The labor representatives pushed for protection, but the process appears to be at impasse.
Whether or not there is CONSENSUS on this issue, Cal/OSHA has the authority to act to protect construction workers (there is a necessity and the law requires them to act under Labor Code Section 144.6). Whether Cal/OSHA recommends anything to the OSH Standards Board remains to be seen. The OSH Standards Board had granted a petition filed by the State Building & Construction Trades Council of CA in 1986, and referred the matter to Cal/OSHA to convene an Advisory Committee, but the petition was "lost" and so Cal/OSHA didn't convene a group until about 3 years ago, and the OSH Standards Board has never received any further recommendations.
WORKSAFE! was surprised that another meeting of the Noise Advisory Committee was scheduled for July 27, 2005. That meeting, however, was then cancelled by Cal/OSHA Staffer Bob Nakamura on July 12, 2005, and no new date was scheduled. Bob mentioned that Cal/OSHA had a couple of things to wrap up like the technician qualifications and one of the testers wants to have insert earphones in the background level change. It is possible that the AGC is open to further negotiations as well with the State Building Trades (the originator of the petition to apply hearing protection to construction workers), but we have no firm information on this.

SUBJECT: SILICA NEXT MEETING: Dec 13, 2007 at OSH Standards Board ACTION: The proposed regulation was heard by the OSH Standards Board on December 13, 2007. There was essentially no opposition to the Dry Cutting Standard at the hearing. The only issue that was controversial was raised by a group of contractors who want to make the use of the filtering face piece voluntary. ROOFING was NOT covered by the prohibition on dry cutting and therefore ROOFER WILL CONTINUE TO BE EXPOSED TO SILICA when cutting roof tiles containing silica. Previously, Cal/OSHA convened regulatory advisory committee meetings on January 17, 2007 and March 26, 2007. This move towards developing a regulation was a result of legislation introduced in the previous legislative session (2005-2006) - see SB 46 by then State Senator and now State Assembly Member Alarcon. Cal/OSHA promised to develop a regulation to address work practices related to silica (to eliminate the hazards of dry cutting). Worksafe attended the regulatory advisory committee meeting. Unions participating (directly or through representatives) included CA Labor Fed, State Building & Construction Trades Council of CA, Bricklayers & Allied Crafts, Carpenters, Laborers, Pipetrades and Roofers among others.
